Terms of Service
These terms govern your use of Dusky, the messaging app published by Dusky Technologies Inc. By using Dusky, you agree to these terms. They're written to be understandable, not to trick you.
1. What You're Agreeing To
Dusky is a messaging client that aggregates conversations from WhatsApp, Discord, Instagram, Facebook Messenger, Telegram, and email into one app. It runs on the Matrix protocol and includes an AI assistant (hiDusky) powered by Google Gemini.
By creating an account or using the app, you agree to these terms and our Privacy Policy.
2. Your Account
- You must be at least 16 years old to use Dusky.
- You're responsible for keeping your account credentials secure.
- You're responsible for all activity under your account.
- One human, one account. No bots or automated signups.
3. Connecting Third-Party Services
Dusky lets you connect your accounts on WhatsApp, Discord, Instagram, Facebook Messenger, Telegram, and various email providers. A few things to understand:
Bridge reliability: Message bridges are complex. They depend on third-party APIs and protocols that can change without notice. We do our best to keep bridges working, but we cannot guarantee uninterrupted service for any bridged platform. WhatsApp might change their protocol. Discord might update their gateway. These things happen and they're outside our control.
- Your credentials, your risk. When you connect a third-party account, you provide your credentials. You're responsible for ensuring this complies with that platform's terms of service.
- No guarantees on delivery. We cannot guarantee that messages sent through bridges will be delivered, or delivered on time. For critical communications, use the native apps as a fallback.
- Platform bans. Some platforms may flag or ban accounts that connect through third-party bridges. Dusky Technologies Inc. is not responsible if a platform restricts your account due to bridge usage.
- Bridge features vary. Not all features from every platform are available through bridges. Reactions, read receipts, voice messages, and other features may have limited support.
4. hiDusky AI
hiDusky is an AI assistant integrated into Dusky. Important things:
- AI makes mistakes. hiDusky is a language model. It can be wrong, sometimes confidently wrong. Don't rely on it for medical, legal, financial, or safety-critical decisions.
- Your data goes to Google. When you use hiDusky, conversation context is sent to Google's Gemini API. See our Privacy Policy for details.
- AI is opt-in. hiDusky only processes your messages when you explicitly invoke it.
- No guarantees on AI output. We don't warrant the accuracy, completeness, or usefulness of any AI-generated content. hiDusky's responses are not professional advice of any kind.
- You own your prompts. Anything you write to hiDusky remains yours. Anything hiDusky generates for you is provided as-is for your personal use.
5. Acceptable Use
Don't use Dusky to:
- Send spam or unsolicited bulk messages
- Harass, threaten, or abuse other people
- Distribute malware or attempt to compromise other users' accounts
- Violate any applicable law
- Impersonate other people or entities
- Attempt to reverse-engineer, attack, or exploit the service infrastructure
- Use the service to train AI models without explicit permission
We reserve the right to suspend or terminate accounts that violate these rules.
6. Open Source
Dusky is open source under the GNU Affero General Public License v3 (AGPL-3.0). You can view, fork, and modify the source code on GitHub.
The AGPL license applies to the software. These Terms of Service apply to the hosted service at hidusky.com and associated infrastructure (matrix.hidusky.com). If you self-host Dusky, these terms don't apply to your instance -- but the AGPL license terms still do.
7. Service Availability
- We aim to keep Dusky available 24/7 but make no uptime guarantees.
- We may need to take the service down for maintenance, upgrades, or emergency fixes.
- We'll try to give advance notice for planned downtime, but can't always.
8. Disclaimer of Warranties
Dusky is provided "as is" and "as available" without warranties of any kind, either express or implied. Specifically:
- We don't warrant that bridges to third-party platforms will work reliably or at all.
- We don't warrant that hiDusky AI responses will be accurate, complete, or appropriate.
- We don't warrant that the service will be uninterrupted, secure, or error-free.
- We don't warrant that any data transmitted through the service will be delivered.
9. Limitation of Liability
To the maximum extent permitted by law, Dusky Technologies Inc. and its team shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising out of or related to your use of Dusky.
This includes, without limitation: messages that fail to deliver, AI responses that are incorrect, bridge connections that break, or data that is lost. Our total liability to you for any claim arising from the service is limited to the amount you've paid us in the 12 months before the claim (which, if you're on the free tier, is zero).
10. Your Content
- You own your messages, media, and content. We don't claim any rights to it.
- By using the service, you grant us a limited license to store and transmit your content as needed to provide the service (i.e., syncing messages across your devices, bridging to other platforms).
- You can delete your content and account at any time.
11. Changes to Terms
We may update these terms. If we make material changes, we'll notify you through the app at least 14 days before they take effect. Continued use after that constitutes acceptance. If you disagree with changes, you can delete your account.
12. Termination
- You can stop using Dusky and delete your account at any time.
- We can suspend or terminate your account if you violate these terms.
- If we shut down the service entirely, we'll give at least 30 days notice and provide data export tools.
13. Governing Law
These terms are governed by the laws of France. Any disputes will be resolved in the courts of Paris, France.
